Terms and Conditions of Use

Last updated: October 14, 2026 • v2026.1

Welcome to Mnemone (“Platform”, “Service”). The Platform is operated by Alessandro Gibello (“Operator”), reachable via the official email address: [email protected].

By accessing or using the Platform, the user agrees to fully comply with these Terms and Conditions (“Terms”). Use of the Service is not permitted to anyone who does not accept these Terms.

1. Nature of the Service, Educational Purpose, and Exclusion of Academic Warranties

  • The Platform allows users to create, upload, share, publish, or consult study content and educational materials, including flashcards, multiple-choice quizzes, lecture notes, texts, and multimedia learning elements (“User Content”).
  • Purely educational and practice purpose (AI Act - Regulation EU 2024/1689): The quizzes, simulations, explanations, and materials available on the Platform (including those generated or reprocessed through Artificial Intelligence models pursuant to Article 50 of Regulation (EU) 2024/1689 or FSRS spaced-repetition algorithms) are intended solely as auxiliary practice tools to support individual self-study. Such automated outputs may contain conceptual inaccuracies or material errors.
  • No guarantee of passing examinations: The Operator does not warrant the absolute scientific, factual, or pedagogical accuracy of questions or answers, nor does it guarantee in any manner the passing of university exams, entrance tests, public competitions, or the achievement of specific grades. Verification of concepts against official textbooks and syllabi adopted by course instructors remains the sole responsibility of the student. The Operator shall not be held liable for negative grades, examination failures, or the loss of academic credits or scholarships.
  • Access to and use of the Platform are provided on an “as is” and “as available” basis, without warranties of uninterrupted availability, complete absence of technical errors, or fitness for a particular purpose.
  • The Operator reserves the right to update, improve, or modify the features of the Service with reasonable discretion and for legitimate technical or pedagogical reasons, in compliance with Section 10.

2. Platform Ownership and Absence of Academic Affiliation

  • The Platform in all its components — including software, source code, database architecture, FSRS spaced-repetition algorithms, graphical interfaces, trademarks, logos, and original written materials developed by the Operator (“Platform Elements”) — constitutes an intellectual work protected by Italian copyright legislation (Law of April 22, 1941, No. 633) and industrial property laws (Legislative Decree of February 10, 2005, No. 30).
  • All rights, titles, and interests relating to Platform Elements are and remain the exclusive property of Alessandro Gibello, unless expressly indicated otherwise.
  • The user is granted a personal, non-exclusive, non-transferable, and revocable license to access and use the Platform solely for personal study and educational purposes. It is strictly forbidden to copy, decompile, disassemble, reverse engineer, sell, or commercially exploit any Platform Elements.
  • Absence of affiliation with Universities or Faculty (Descriptive Trademark Use): Mnemone is an independent, autonomous platform. Any references, citations, or mentions of universities, polytechnics, departments, degree programs, or faculty names (e.g., "Politecnico di Torino", "Università di Bologna", "Sapienza", etc.) are used by users or the Platform strictly for descriptive and nominative purposes to identify the disciplinary field and subject matter of examinations — pursuant to Article 21 of Legislative Decree No. 30/2005 (Italian Industrial Property Code), Article 14 of Directive (EU) 2015/2436, and Article 14 of Regulation (EU) 2017/1001 on the European Union trade mark — and do not in any case imply affiliation, sponsorship, endorsement, official partnership, or patronage by such institutions or professors.

3. User Accounts, Minimum Age, and Security

  • Minimum age for digital consent: Registration and use of the Service are permitted to users who are at least 14 years old, in full compliance with Article 8 of Regulation (EU) 2016/679 (GDPR) and Article 2-quinquies of Legislative Decree No. 196/2003 (Italian Privacy Code) (or the applicable legal age required in their country of residence to provide autonomous consent to information society services). Users under this age may only use the Service with prior permission and under the active supervision of a parent or legal guardian.
  • To take advantage of study features, cloud progress saving, and 1v1 challenges, the user creates a personal account by providing accurate information and a valid email address.
  • The user is solely responsible for maintaining the confidentiality of their authentication credentials and for all activities carried out through their account.
  • The user agrees to notify the Operator promptly at [email protected] of any suspected unauthorized access or breach of security regarding their account.
  • The Operator employs industry-standard cryptographic measures to protect credentials (secure password hashing and encrypted HTTPS TLS 1.3 connections).

4. User Content, Copyright, and Ownership of Rights

  • Ownership remains yours: All learning materials, questions, study decks, answers, and notes uploaded or created by the user remain the exclusive intellectual property of the authoring user.
  • Didactic use and quotation (Law of April 22, 1941, No. 633): The creation of questions and study summaries is permitted within the legal boundaries of summary, quotation, and non-commercial educational or scientific use pursuant to Article 70 of the Italian Copyright Law (Law No. 633/1941 - LDA), without prejudice to the prohibition of unauthorized full reproduction of third-party copyrighted textbooks or course packets.
  • Limited technical license: By uploading User Content, the user grants the Operator a free, worldwide, non-exclusive, and temporary license, strictly limited to what is necessary to operate the Service (namely storing, algorithmically processing, synchronizing across the user's devices, displaying the content during study sessions, and, where the user chooses to make materials public, shareable via link, or participate in 1v1 challenges, rendering them accessible to other authorized users of the Platform).
  • Automatic termination: This technical license terminates automatically and entirely the moment the user deletes the respective Content from the Platform or closes their account (without prejudice to temporary technical persistence solely in encrypted security backup cycles, not publicly accessible, for the time strictly required for their rotation).
  • Responsibility for materials: The user warrants that they are the legitimate author of uploaded materials or hold the necessary rights to use them on the Platform. To the maximum extent permitted by applicable consumer protection laws, the user is directly accountable for any culpable infringement of third-party rights.

5. Absence of Advertising and Economic Transparency

  • Mnemone is an independent educational platform designed to guarantee maximum focus and clarity while studying.
  • The Platform does not host third-party network advertisements, intrusive promotional banners, or cross-site tracking pixels.
  • Core individual study features are provided free of charge, with no hidden fees or unrequested recurring charges. Any future introduction of optional additional features or voluntary support contributions will always be clearly presented and subject to explicit user agreement.

6. Prohibited Conduct

Users are strictly prohibited from using the Platform to:

  • Pursue objectives contrary to applicable law, public order, or infringing the fundamental rights of third parties;
  • Upload, transmit, or share defamatory, insulting, threatening, obscene, or discriminatory content;
  • Upload exam papers covered by academic official secrecy, confidential test questions, or materials for which university regulations or third parties impose an explicit confidentiality or non-disclosure obligation;
  • Introduce viruses, trojans, malicious scripts, or any code designed to damage or compromise the integrity of computer systems;
  • Perform unauthorized automated scraping, abusive data mining, or systematic extraction of content using bots, spiders, or crawlers without prior written authorization;
  • Attempt to circumvent authentication mechanisms, security controls, rate limiting, or compromise Platform APIs.

7. Hosting Provider Status and Takedown Procedure (DSA - Regulation EU 2022/2065)

  • Hosting Provider status (Liability Exemption): The Operator acts as an intermediary information society service provider and hosting service provider pursuant to Article 16 of Legislative Decree No. 70/2003, Article 14 of Directive 2000/31/EC, and Article 6 of Regulation (EU) 2022/2065 (Digital Services Act - DSA). The Operator does not exercise ex-ante control over user-uploaded content, is not the author of user materials, and benefits from the statutory liability exemption (Safe Harbor), conditioned upon acting expeditiously to remove or disable access to information as soon as it becomes aware of illegal activity or content.

DSA Single Point of Contact (Arts. 11 & 12 DSA)

  • Assessment and action: The Operator reviews the notice with due diligence and, where substantiated grounds of unlawfulness exist, promptly disables or removes the contested content.
  • Statement of Reasons (Art. 17 DSA): In the event of content removal or restriction, the Operator promptly notifies the authoring user of clear and specific reasons for the decision, indicating the grounds received and ensuring the opportunity to clarify their position or lodge a reasoned internal complaint in case of material error.

8. Exclusion and Limitation of Liability

  • To the maximum extent permitted by mandatory applicable law, and except in cases of intentional misconduct or gross negligence (in accordance with Article 1229 of the Italian Civil Code):
  • The Operator shall not be held liable for indirect, incidental, special, or consequential damages, loss of data, loss of anticipated revenue, or study interruptions resulting from the use or inability to use the Service or from conceptual inaccuracies in quizzes.
  • The total aggregate liability of the Operator for any contractual or non-contractual claim shall in no event exceed the total amount paid by the user to access the Service in the twelve (12) months preceding the event or, in the absence of payments, the maximum amount of fifty euros (€ 50.00).
  • Preservation of consumer rights: This limitation applies strictly without prejudice to mandatory statutory damages and remedies granted by law to users acting in their capacity as consumers under Articles 33, 34, and 36 of Legislative Decree No. 206/2005 (Italian Consumer Code) and personal data protection regulations (Regulation EU 2016/679).

9. Indemnification

To the maximum extent permitted by applicable consumer protection laws, the user agrees to defend, indemnify, and hold harmless the Operator from any claim, demand, liability, damage, loss, or legal cost asserted by third parties directly arising out of:

  • A culpable and serious breach of these Terms or Prohibited Conduct (Section 6) by the user;
  • The uploading or intentional dissemination of User Content that infringes copyright, trade secrets, or privacy rights of third parties;
  • Unlawful or fraudulent use of the Service conducted using the user's credentials.

10. Modifications and Updates to the Terms

  • The Operator reserves the right to update or modify these Terms with reasonable discretion to reflect legislative changes, regulatory requirements, or technical developments of the Service.
  • Any material modifications will be communicated to users with at least thirty (30) days' prior notice before their effective date, via a prominent notice on the Platform or by email to the registered address.
  • Users who do not wish to accept contractual changes have the full right to terminate the Service at any time without penalty by deleting their account before the effective date of the new Terms. Continued use of the Platform after that date constitutes full acceptance of the updated Terms.

11. Account Suspension and Closure

  • Closure by the user: The user may terminate this agreement and delete their account at any time directly through profile settings, resulting in immediate deletion of personal data and memory retention records in accordance with our Privacy Policy.
  • Suspension for legitimate cause: The Operator may suspend or limit user access with reasonable discretion and for legitimate cause, upon reasoned communication where reasonably possible, in the event of:
  • Serious or repeated breach of these Terms or Prohibited Conduct (Section 6);
  • An order issued by a competent judicial, administrative, or law enforcement authority;
  • Mandatory technical necessity aimed at preserving the security and operational integrity of the Platform against cyberattacks or severe abuse.

  • Amicable resolution: In case of inquiries, doubts, or disputes, we encourage users to contact the Operator primarily at [email protected] to pursue a cooperative, amicable resolution.
  • Competent jurisdiction and Consumer Forum: Any dispute that cannot be resolved amicably shall be submitted to the ordinary courts determined pursuant to applicable legislation.
